THE OPERATOR OF THIS E-SHOP IS UAB “JOLDIJA”.
1.2. The Company – UAB “Joldija”, registered and operating in accordance with the laws of the Republic of Lithuania, company code: 133865639, VAT payer code: LT338656314, registered office address / mailing address: Tikslo g. 10, LT-54311, Kumpių k., Kauno r. sav.
1.3. E-shop – an electronic shop on the Website.
1.4 User – a natural person who visits the Website.
1.5 Terms and Conditions – This document, approved by the Company, which sets out the basic rules for the collection, storage, processing and retention of Personal Data when using the E-Store.
1.6 Offer – an offer of the selected Product provided by the Seller to the Buyer and sent to the e-mail address specified by the Buyer.
1.7 Account – the result of the Buyer’s registration in the E-Store, which results in the creation of an account that stores his/her personal data and order history.
1.8.Buyer – a natural or legal person who creates an Account on the Website or submits a Product request, who is able to enter into transactions in accordance with the applicable legislation, or duly authorised representatives of such persons.
1.9 “Product” means any product traded on the Website. As used separately in the Terms and Conditions, the terms “Goods” and “Goods” shall mean both singular and plural.
1.10. “Regulation” means Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC.
1.11. “Contract” means a contract for the sale of Goods.
1.12. Website – the Website www.dexoprofile.eu
1.13. Rules – “Rules for the purchase and sale of goods of the UAB “Joldija” e-shop www.dexoprofile.eu”, which determine the rights and obligations of the Buyer and the Seller, the conditions for the purchase of the Goods and payment for them, the procedure for delivery and return of the goods, the liability of the parties and other provisions relating to the conclusion and execution of the remote Contract and the purchase and sale of the Goods in the E-shop managed by the Seller.

2.4 The Company respects the privacy of Users and protects the Personal Data of Users that you provide to us and that we collect, as set out in these Terms.
2.5 The Company shall take appropriate organisational and technical measures to ensure that the Personal Data processed by the Company is always secure and that the data processing activities comply with the requirements of the Law on Legal Protection of Personal Data of the Republic of Lithuania, the Regulation and other normative and the Company’s internal legal acts.
2.6 Persons under the age of 14 (fourteen) may not provide any personal data to the Company. Anyone under the age of 14 must obtain the consent of their legal representatives (parents, adoptive parents, guardians, custodians) before providing personal information.
3.1.1. Personal data: name, surname, e-mail address, telephone number, company represented, names of goods, quantities.
3.1.2. The Company shall consider the notification of data processing and consent to the Terms and Conditions to have been received when the User submits a Product request to the Company. 2) The processing is carried out for the purpose of the User’s initiative to make a Product offer, i.e. to take action at the request of the data subject prior to the conclusion of the Contract. 3) The processing is necessary to comply with a legal obligation to which the Data Controller is subject. 4) The processing is necessary for the purposes of the legitimate interests of the controller.
3.1.3. Data processing period: the Product request data is stored in the Company’s database for 1 year.
3.2 Account administration and order management.
3.2.1. Personal data: name, surname, email address, telephone number, company represented, delivery and mailing addresses, signature (if you are accepting the Goods yourself), date and time of purchase and delivery, names of the Goods, quantities, prices of purchases and any discounts granted, method of payment for purchases and payment information; history of purchases made through the Account.
3.2.2. Basis: 1) the legitimate interests of the Company (by creating an Account or submitting a Product enquiry without registration). We consider your consent to use the Account to have been obtained when you complete the steps necessary to create an Account as set out in the Terms and Conditions and confirm registration or submit a Product Enquiry. 2) The processing is carried out in order to perform a Contract to which the Data Subject is a party or to take action at the request of the Data Subject prior to the conclusion of the Contract. 3) The processing is necessary to comply with a legal obligation to which the Data Controller is subject. 4) The processing is necessary for the purposes of the legitimate interests of the controller.
3.2.3. data processing period: the Account will be active for 2 years after the last login to the Account. Upon expiry of this period, the Account will be cancelled and its data deleted. Customers have the possibility to cancel their Account themselves at any time or contact the Company for assistance at duomenys@joldija.lt.
3.2.4.After the purchase of Goods through the Website, the data of individual purchases (including invoice data about the Customer) shall be kept in the Company’s accounting records for 10 years.
3.2.5 Depending on the method of delivery of the Goods chosen by the Buyer, the data related to the delivery (the desired time of delivery, the address, other information relevant to the courier) shall be transmitted to the Company’s partner carrying out the delivery of Goods.
3.2.6 Depending on the payment method, the payment information is transmitted to the partner managing the payment service.
3.2.7 If you have opted to receive personalised offers on the Website, we will not only process your profile data for this purpose in order to get to know you better, but we will also analyse and use your purchase data history. This enables us to get to know you, to tailor offers to your needs and to provide you with other benefits specifically for you. For these purposes, we use automated data analysis and decision-making, including profiling. We group and analyse your profile and/or purchase data and provide you with relevant and useful offers and other information based on your shopping habits and/or other attributes (e.g. your area of residence, specific purchase transactions, etc.). The processing of such data is carried out for as long as your consent to the processing of your data for the purpose of providing you with personalised offers is valid. 3.3. Direct marketing (sending newsletters).
3.3.1. Personal data: name, surname, email address, company represented.
3.3.2. Basis: consent of the potential client.
3.3.3. Term: 2 years. After this period, newsletters will no longer be sent without renewal.
3.3.4. Persons who have expressed their consent to direct marketing have the right to withdraw their consent at any time by notifying us of their withdrawal by email to duomenys@joldija.lt or by clicking on the link at the bottom of the newsletter.
3.3.5 Persons under the age of 14 may not provide any personal data for marketing activities via the Website. Persons under the age of 14 must obtain and provide the Company with the consent of their parents or other legal guardians before providing personal information for marketing purposes.
3.4 Recruitment, administration of the database of job applicants.
3.4.1. personal data: (1) general information about the candidate – name, surname, date of birth, place of residence or address of place of residence, e-mail address Information on the candidate’s work experience (employer, period of employment, position, responsibilities and/or achievements), information on the candidate’s education (educational establishment, period of training, education and/or qualifications obtained), information on further training (training attended, certificates obtained), information on language skills, information on information technology, driving skills, other competences, other information that you provide in your CV, cover letter or other candidacy documents (2) references, employer references – the person recommending or giving the reference, their contact details, the content of the recommendation or reference; (3) candidate assessment information – a summary of the interview with the candidate, the insights and opinions of the selector(s), the results of the candidate’s test.
3.4.2. Basis: Consent.
3.4.3. Time limit: If you do not give your explicit consent to the processing of your personal data after the end of the selection process, we undertake to delete and/or destroy your personal data within 5 (five) working days after the successful candidate is awarded the contract.
3.5 Video surveillance.
3.5.1. Personal data: video data of persons entering the CCTV surveillance area, the date and time of the video recordings, the location.
3.5.2. Basis: The company’s legitimate interests and the protection of essential interests, including health and life.
3.5.3. Term: surveillance video recordings shall be kept for a maximum of 60 (sixty) calendar days, except for the following cases where the video recordings shall be kept for longer periods.
3.5.4 The Company shall organise the video surveillance in such a way that the surveillance field does not include more than the strictly necessary area (room, part of a room). Video surveillance in premises and/or areas intended for the private use of individuals.
3.5.5.Video recordings may only be used to disclose suspected criminal offences, administrative offences, or to prove damage to the Company’s property caused by the Company’s employees, service providers, third parties, or the Company’s property, and may only be transferred to persons entitled to receive such data in accordance with the procedure established by law. Video recordings may be allowed to be viewed and, if necessary, transferred to law enforcement authorities upon written request of law enforcement authorities. Where there are reasonable grounds to believe that the surveillance footage captures the commission of a crime or other unlawful acts, the necessary video data (episodes) shall be transferred to secure media and retained for as long as there is an objective need.
4.2 Cookies are used to make it easier for you to remember your settings, to log in to your Account, and to return to find the Goods you have placed in your basket or for which you have made a Product request.
4.3 You have the right to choose whether to accept cookies. You can consent to the use of cookies in the following ways: a) by not deleting them and/or by not changing the settings on your web browser so that it does not accept cookies; b) by clicking on the “I accept” checkbox in the cookie notice on the Website;
4.4 Information about cookies used on the Website:
5.1 Your data may be transferred for processing to third parties operating in the European Union to assist in the performance of Contracts and the administration of the Website. Such persons may include database software providers, database administration service providers, data centre, hosting and cloud service providers, direct marketing service providers, providers of market research or business analytics services, accounting service providers, auditors, legal and financial advisors, etc., and partners engaged for the purpose of fulfilling a specific order (courier service, payment administration service provider, etc.).
5.2 In each case, the data provided to the processor shall be limited to the amount of data necessary for the execution of the specific order or provision of the specific service.
5.3 The data processors engaged by the Company may process personal data only on the Company’s instructions and may not use it for other purposes or transfer it to other persons without our consent. In addition, they must ensure the security of your data in accordance with the applicable legislation and written agreements concluded with us.
5.4 Data may also be provided to competent government or law enforcement authorities or persons exercising functions assigned to them by law, such as the police or supervisory authorities, but only upon request and only when required by applicable law or in the cases and according to the procedures provided by law, in order to safeguard our rights, the safety of our customers, employees and resources, and to assert, bring, submit and defend legal claims.
5.5 If the Company uses a website analytics service (e.g. Google Analytics) to determine how you use the information on the Website, we may share your personalised data with third parties who use this information to evaluate the use of the Website, to compile reports for the Website operators on the performance of the Website, and to provide other services relating to the use of the Website, the Internet and the mobile application.
5.6 Personal data may be transferred and processed outside the EU/EEA where the transfer is necessary for the conclusion and performance of the Contract or with the consent of the Buyer or User, and where appropriate safeguards are in place: a) a contract containing standard terms and conditions adopted by the EU Commission or other approved clauses, codes of conduct, certificates etc., (b) the non-EU/EEA country in which the recipient of the Personal Data is located ensures an adequate level of protection of the Personal Data as decided by the EU Commission; (c) the recipient is certified in accordance with the requirements of the Data Protection Agreement between the EU and the United States of America (USA) (also known as the “Privacy Shield”) (applicable to recipients located in the USA). In the absence of any of the above-mentioned adequate safeguards, the Company may avail itself of the exemptions provided for in Article 49 of the Regulation, but these may only be applied in strictly limited circumstances as formulated in the Regulation.

6.1.2. have access to your data and how it is processed (right of access);
6.1.3. to request the rectification or, depending on the purposes of the processing of the personal data, the completion of incomplete Personal Data (the right to rectification);
6.1.4. to have your data destroyed (right to be forgotten);
6.1.5. to request the Company to restrict the processing of Personal Data on one of the legitimate grounds (right to restrict);
6.1.6. the right to data portability (right to port);
6.1.7. the right to object to the processing of his Personal Data or to withdraw his consent to the processing of Personal Data for one or more specific purposes at any time, without prejudice to the lawfulness of the processing based on consent prior to the withdrawal of consent;
6.1.8. to lodge a complaint regarding the processing of personal data with the State Data Protection Inspectorate (www.ada.lt), if he/she believes that Personal Data is processed in the Company in violation of the requirements of legal acts.

7.2 This version of the Regulations shall apply from 31 January 2019. The Company may update or amend these Terms and Conditions at any time. Such updated or amended Terms and Conditions will take effect from the date of their publication on the Website.
